These Terms and Conditions (“Agreement”) outline the rules and guidelines for the use of services provided by Casper Sebastiaan. By entering into an agreement with us, you (the “Client”) agree to comply with the terms set out below.

1. Introduction

All personal and sensitive information provided by the Client during our working relationship will be treated as confidential and will not be disclosed to third parties without prior consent.

2.1. Both parties agree to maintain the confidentiality of the project details, and Casper Sebastiaan will ensure that all information related to the player's brand or image remains private unless explicitly authorised by the Client.

2. Confidentiality

Any pricing, quotes, or estimates provided by Casper Sebastiaan are valid for a period of 30 days from the date of issuance.

3.1 Casper Sebastiaan reserves the right to amend any quotes if the scope of work changes significantly after initial discussions.
3.2 All quotes are based on the scope of services initially agreed upon. Any additional services requested by the Client will incur extra charges.

3. Quotes

A project is confirmed once the Client has accepted a written proposal or quote, signed an optional contract, and provided any necessary deposit or payment.

4.1 Casper Sebastiaan will begin work only after a project is confirmed by the Client according to the actions described above.
4.2 If the Client fail to provide necessary materials or feedback within a reasonable timeframe, Casper Sebastiaan reserves the right to adjust the delivery schedule.

4. Project Confirmation

Payment terms are as follows:

6.1 For new clients or projects with significant upfront costs, a deposit of 50% of the total project fee is required upon confirmation of services, at least 7 days before the scheduled shoot or event.
- 6.1.2 Projects initiated within 7 days of the scheduled shoot or event are not guaranteed and require confirmation (4.0) as soon as possible.
6.2 The remaining balance is due upon project completion with a 30-day payment period unless otherwise agreed in writing.
6.3 Late payments will incur an interest charge of 5% per month on any outstanding amounts beyond the due date.

5. Payment

If the Client needs to reschedule or cancel a project, the following policies will apply:

5.1 Rescheduling must be requested at least 48 hours prior to the scheduled shoot or event, and new dates will be agreed upon based on mutual availability.
5.2 Cancellation requests made more than 7 days before the scheduled shoot or event will incur no penalty. Cancellations made within 7 days of the scheduled shoot or event will result in an invoice being issued for 50% of the quoted amount.
5.3 Any expenses incurred by Casper Sebastiaan in preparation for the project (e.g., travel or equipment costs) will still be charged to the Client in case of cancellation.

6. Rescheduling or Cancellation

All intellectual property rights, including copyrights, remain with Casper Sebastiaan unless otherwise agreed upon in writing.

7.1 Upon full payment, the Client is granted a non-exclusive non-transferable license to use the final materials for personal branding purposes.
7.2 The Client is not permitted to sell, distribute, modify or commercially use the materials without prior written permission from Casper Sebastiaan.
7.3 Casper Sebastiaan reserves the right to use the materials for promotional purposes, unless the Client expressly requests otherwise in writing.

7. Copyrights and Usage Rights

Casper Sebastiaan will take all necessary precautions to ensure the highest quality of work; however, we cannot be held liable for:

8.1 Any damage, loss, or issues arising from unforeseen circumstances or events beyond our control, such as equipment failure, weather conditions, or accidents during production.
8.2 Any direct or indirect damage arising from the use of the delivered materials by the Client or third parties.

8. Liability

Casper Sebastiaan reserves the right to amend these Terms and Conditions at any time. Changes will be communicated to existing clients.

9.1 Continued use of our services after any modifications to the Terms constitutes acceptance of the updated terms.

9. Changes to Terms

This Agreement and any disputes or claims arising out of or in connection with it shall be governed by and construed in accordance with the laws of the Netherlands.

10.1 Any disputes will first be resolved through negotiations between the parties.
